Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and DPA Tech Solutions SRL ("WhereU", "we", "us"), governing your use of the WhereU mobile and web app, the website at whereu.fun and related services (together, the "Service"). By creating an account or using the Service you agree to these Terms.

This page is maintained by DPA Tech Solutions SRL. It is a plain-language legal document and not a certification.

1. Eligibility

You must be at least 16 years old and able to enter into a binding contract to use WhereU. Some paid or age-restricted features (e.g. certain events) may require a higher minimum age indicated at checkout. If you use the Service on behalf of an organization, you confirm that you are authorized to bind it.

2. Your account

Access is invitation-based: you sign up with an invite link or from a whitelisted address. You choose a unique username and are responsible for keeping your credentials safe and for anything that happens under your account. Notify us immediately at support@whereu.fun if you suspect unauthorized access. You may delete your account at any time from whereu.fun/data-deletion or the in-app settings.

3. Acceptable use

  • No harassment, hate speech, threats, doxxing or stalking of other users.
  • No fake accounts, scraping or automated collection of user data.
  • No sharing of another person's location, photo or contact details without their consent.
  • No illegal content, fraud, spam or attempts to circumvent security controls.
  • No use of the Pulse (shake) gesture, ping system, group chats or DMs to intimidate, deceive or manipulate others.
  • Hosts are solely responsible for the lawfulness of the events they create, the safety of attendees and any tickets they sell (including refunds, VAT and local permits).
  • Squad admins are responsible for the members they invite and for moderating group chats they own.

You can report abuse, block another user, or hide content from the profile, chat and place-details screens. We may suspend or terminate accounts that violate these rules, remove content, and cooperate with lawful authorities when required.

4. User content

You keep ownership of the content you post (profile info, photos, saved places, events, group and direct messages, reactions, vibe checks, ping notes). You grant us a worldwide, royalty-free, non-exclusive license to host, cache, display, transmit and distribute that content solely to operate, secure and improve the Service and to deliver it to the users you choose to share it with.

Content in group chats and 1:1 DMs is visible to participants of that thread and, where you enable them, to features such as read receipts, typing indicators and message reactions. Public content on shareable place, event and profile links may be indexed by search engines and shown in social previews (Open Graph / Twitter cards).

5. Paid features, WhereU PRO and event tickets

Certain features are paid, currently including WhereU PRO (Ghost Mode+, extended location history, expanded radar, larger squads, scheduled DMs, custom map themes, monthly host boosts), Stranger Dinners extra seats above the one free monthly seat ($4 per seat), host plans, promoted event pins and paid event tickets.

  • Prices, currency and taxes are shown in the app before you pay.
  • Payments are processed by Stripe. We do not receive or store your full card details.
  • Subscriptions renew automatically for the period you selected until you cancel. You can cancel at any time from whereu.fun/billing; cancellation stops future renewals and you keep access until the end of the paid period.
  • Event tickets are sold on behalf of the host. Refunds, changes and cancellations for tickets are handled by the host under the terms shown on the event page. WhereU is a technical intermediary and not a party to the ticket contract.
  • EU consumers may cancel a digital subscription within 14 days of purchase. Where you expressly ask us to start delivering paid digital features immediately and acknowledge that this waives the withdrawal right, the exception in art. 16(m) of Directive 2011/83/EU applies and no refund is due for the period already used.

6. Location, Pulse and safety features

WhereU lets you share your live location with friends, discover events and places near you, and use the "Pulse" shake gesture to greet nearby users or auto-add close-by people as friends. You decide when to enable sharing, with whom, at what precision, and for how long. Ghost Mode and Ghost Mode+ (PRO) let you selectively hide from specific people or lists.

Sample rate, distance and heartbeat for background location writes are configurable in Settings; see the Privacy Policy for the exact defaults. Live locations older than 15 minutes are hidden from the map by default. WhereU is not a personal safety, security or emergency service and must not be relied on as one. We are not responsible for the consequences of voluntarily sharing your location with others or of meeting people you first met on the Service.

7. Agent / MCP integrations

WhereU exposes a Model Context Protocol (MCP) endpoint at whereu.fun/mcp so you can grant AI assistants you trust access to a limited set of actions on your account (e.g. list friends, list upcoming events, RSVP, send pings). Access is granted per-agent through an OAuth-style consent screen and can be revoked at any time. You are responsible for the actions taken by agents you authorize.

8. Service availability and mobile apps

The Service is provided "as is" and "as available". We try to keep it reliable but do not guarantee uninterrupted operation, and we may add, modify, suspend or discontinue features at any time.

Native apps distributed via the Apple App Store and Google Play are additionally subject to the applicable store terms. On iOS, digital-goods purchases governed by App Store rules may be unavailable or hidden until compliant billing is enabled.

9. Intellectual property

The WhereU name, logo, product design, code and content (excluding user content) are owned by DPA Tech Solutions SRL and protected by intellectual property laws. Nothing in these Terms transfers those rights to you.

10. Liability

To the maximum extent permitted by law, DPA Tech Solutions SRL is not liable for indirect, incidental, special or consequential damages, lost profits, lost data or loss of goodwill arising from your use of the Service, including from meetups, events, transactions between users, agent integrations or reliance on location data. Our total liability for any claim is capped at the greater of the amount you paid us in the 12 months before the claim or 100 EUR. Nothing in these Terms limits liability that cannot be limited under Romanian or EU law, including consumer rights.

11. Termination

You may stop using and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the safety of other users. On termination, sections that by their nature should survive (payments, liability, IP, governing law) will remain in force.

12. Changes to these Terms

We may update these Terms to reflect new features, legal requirements or operational changes. We will notify you of material changes in the app or by email at least 15 days before they take effect (unless a change is required by law to apply sooner). Continued use after the effective date means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by Romanian law. Any dispute will be submitted to the competent courts of Romania, without prejudice to mandatory consumer protection rules in your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
