Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and DPA Tech Solutions SRL ("WhereU", "we", "us"), governing your use of the WhereU app, website and related services (the "Service"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 16 years old and able to enter into a binding contract to use WhereU. If you use the Service on behalf of an organization, you confirm that you are authorized to bind it.

2. Your account

You are responsible for keeping your login credentials safe and for anything that happens under your account. Notify us immediately at support@whereu.fun if you suspect unauthorized access.

3. Acceptable use

• No harassment, hate speech, threats or stalking of other users.
• No fake accounts, scraping or automated collection of user data.
• No sharing of someone else's location without their consent.
• No illegal content, fraud or attempts to circumvent security.
• Hosts are responsible for the lawfulness of events they create and for any tickets they sell.

We may suspend or terminate accounts that violate these rules, with or without notice.

4. User content

You keep ownership of the content you post (profile info, events, messages, photos). You grant us a worldwide, royalty-free, non-exclusive license to host, display and distribute that content solely to operate and improve the Service.

5. Paid features and subscriptions

Some features (e.g. Host Plans, premium event pins) are paid. Prices are shown in the app and processed by Stripe. Subscriptions renew automatically until cancelled. EU consumers can cancel a digital subscription within 14 days unless they have started using paid features, in which case the right of withdrawal is waived in line with art. 16(m) of Directive 2011/83/EU.

6. Location features

WhereU lets you share your live location with friends. You decide when to enable sharing, with whom, and for how long. We are not responsible for the consequences of voluntarily sharing your location with others.

7. Service availability

The Service is provided "as is". We try to keep it available and reliable but we cannot guarantee uninterrupted operation, and we may modify, suspend or discontinue features at any time.

8. Liability

To the maximum extent permitted by law, DPA Tech Solutions SRL is not liable for indirect, incidental, special or consequential damages, lost profits or data loss. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim, or 100 EUR, whichever is greater. Nothing in these Terms limits liability that cannot be limited under Romanian or EU law.

9. Termination

You can stop using and delete your account at any time. We may terminate or suspend your access if you breach these Terms.

10. Governing law

These Terms are governed by Romanian law. Any dispute will be submitted to the competent courts of Romania, without prejudice to mandatory consumer protection rules in your country of residence.
